Welcome to A Plus Holdings LLC DBA Rise ‘n’ Shine Pool Service (“Company,” “we,” “us,” or “our”). By signing up for and using our services, you (“Customer”) agree to these Terms of Service (“Agreement”). These terms outline our services, mutual responsibilities, important liability limitations, and consent policies.
1. Service Overview
Rise ‘n’ Shine Pool Service provides regular pool maintenance services based on the selected service level. The scope of services includes:
- Water Testing & Balancing: Weekly testing for chlorine, alkalinity, and pH. Additional advanced tests (CYA, TDS, Calcium Hardness, Phosphates) are available as separate services for an additional fee.
- Cleaning Baskets: (ChemPlus, Full Service)
- Brushing Steps & Walls (as needed): (Full Service)
- Skimming Debris (as needed): (Full Service)
- Filter Backwashing (once per month): (Full Service only; customer is responsible for additional backwashing as required).
Saltwater Systems: Cleaning salt cells and salt treatments are not included in regular service and will be billed separately.
Cartridge Filter Cleaning: Cleaning filter cartridges are not included in regular service and will be billed separately.
Maximum Service Time: Each service visit is capped at 20 minutes for Full Service, 15 minutes for Chemical Plus service and 10 minutes for Chemical Only service. Additional time or services may be subject to extra charges.
Service Day & Time Changes: We reserve the right to permanently change a customer’s service day or time to ensure operational efficiency and continued growth. Customers will be notified in advance of any such changes.
Please note: We use strict chemical dosing based on readings taken during our service visit. These dosages are based solely on the readings taken during that visit. Any additional chemical for adjustments or treatments may have additional fees.
2. Important Notes on Pool Maintenance
Pool maintenance is affected by several factors beyond our control, including but not limited to:
- Weather conditions and unexpected storms
- Heavy pool usage by people or animals
- Nearby landscaping, dirt yards, trees, and environmental debris
- Lack of timely equipment repairs or maintenance
- Unforeseen algae blooms or water quality changes
Rise ‘n’ Shine Pool Service is not responsible for issues arising from these factors.
3. Customer Responsibilities
To ensure effective service and maintain optimal pool conditions, the Customer agrees to:
- Filter Cleaning: This service is required every 6 months (or sooner as needed) and will be prescheduled and pre-billed by us.
- Maintain Pool Water Chemistry: Authorize necessary water testing, balancing, and pool drains when recommended. Failure to do so may result in long-term damage for which we are not liable.
- Timely Equipment Repairs: Address repair recommendations immediately for critical issues or within 7 days for urgent repairs. Delays may cause equipment failure, algae growth, or water quality issues for which we are not liable.
- Provide Access: Ensure gates are unlocked, pets secured, and pool areas clear of hazards. If the pool is inaccessible, the service will be skipped, and a $25 fee may apply.
- Additional tasks including but not limited to brushing, netting, and chemical adjustments may be required in between scheduled visits to properly maintain a swimming pool. Please reference Section 2. Important Notes on Pool Maintenance and Section 4. Limitations of Liability for additional information.
4. Limitations of Liability
Rise ‘n’ Shine Pool Service is not liable for the following but including but not limited to:
- Pre-existing damage or defects
- Damage caused by scaling, corrosion, or chemical imbalances
- Service interruptions due to unpaid balances, lack of access, or failure to address recommendations
- Past damage that later becomes visible during service
- Unexpected algae blooms, water quality issues, or equipment failures caused by external factors
- Pool water chemistry beyond weekly testing and adjusting of chlorine, pH, and alkalinity. Please note that other chemicals and factors may impact the effectiveness of chlorine and balance of pH, alkalinity, and other pool water chemistry.
5. Weather & Service Skips
- Up to 5 service skips per year may occur due to inclement weather, illness, or unavoidable reasons. These skips will not be rescheduled.
- No service will be provided during Thanksgiving and Christmas weeks (10 days total).
6. Payment & Fees
- Payment is due by the 1st of each month.
- If payment is not received within 5 days, service may be suspended or canceled.
- A late fee of $25 or 1.5% of the overdue balance, whichever is higher, will apply.
- We reserve the right to suspend or terminate service until the balance is paid in full.
- If payment is received late 2 times, the customer may be required to be signed up for our autopay service
Prepayment for Advanced Services: Customers must prepay for diagnostic evaluations and advanced services (e.g., algae treatments, repairs) before work is performed.
7. Communication & Consent for Automated Contact
By using our services, you consent to receive communications which include but are not limited to:
- Autodialed calls, AI calls, voicemail drops, SMS/text messages, and emails for service updates, promotions, and notifications.
- Standard messaging rates may apply.
Failure to read or respond to notifications absolves us of liability for related issues.
8. Advanced Services & Diagnostic Fees
Certain issues require a paid diagnostic evaluation before treatment. Failure to authorize diagnostics may result in unresolved issues for which we are not liable. Pricing for advanced services varies based on severity.
9. Use of Photos, Videos, and Marketing Consent
By using our services, you grant Rise ‘n’ Shine Pool Service the irrevocable right and unrestricted permission to:
- Take and use photos and videos of your pool/property in our social media, website, marketing materials, and advertisements.
- Share such content with third-party marketing and advertising partners.
- Use these materials without compensation to you.
10. Google Ads & Data Sharing Compliance
To provide personalized advertising and improved customer service, we may share customer data with third-party services, including but not limited to Google Ads and Customer Match programs.
- Our Privacy Policy discloses that we may share customer data with third parties to perform services on our behalf.
- You consent to this sharing in compliance with Google’s EU User Consent Policy, GDPR, and applicable privacy laws.
- Shared data is only used to match your information to Google accounts and for campaign compliance.

11. Termination of Service
We reserve the right to suspend or terminate service at any time and for any reason, including but not limited to:
- Payment is overdue for more than 5 days.
- The Customer refuses required diagnostics, filter cleaning, equipment repairs, or any other necessary services, including but not limited to algae treatments or repairs performed by third parties, that are essential to maintaining proper pool conditions.
If service is terminated for any reason, the remaining balance for the month and any outstanding invoices becomes immediately due.
12. Dispute Resolution
In the event of a dispute, both parties agree to:
- Attempt informal resolution.
- If unresolved, participate in mediation.
- If mediation fails, submit to binding arbitration under American Arbitration Association rules.
Acceptance of Terms
